Covenant Not to Sue
And Indemnity Agreement
I, ________________________, the undersigned, agree and understand that the honor fraternity, Phi Sigma Pi – CHAPTER, is neither a host, sponsor, nor responsible party in any way for the EVENT on DATE. I also acknowledge that Phi Sigma Pi has absolutely no responsibility or liability for me, either while traveling to or from LOCATION or during that time that I remain in LOCATION on DATE. I further acknowledge and agree that neither Phi Sigma Pi or any of its officers, agents, directors or other representatives will have any legal or other responsibility for me at any time, including but not limited to the time during which I may travel to and from LOCATION by bus, car, or other vehicle with other members of Phi Sigma Pi.
Furthermore, I fully and completely agree to hold Phi Sigma Pi – CHAPTER, its officers, agents, directors, and representatives fully and completely harmless and free from any and all liability or responsibility to me, my heirs, successors and/or assigns in the event I sustain any personal illness or injury on DATE, including the time during which I am traveling to and from LOCATION, whether or not caused by the sole concurrent fault, act and/or omission of the said Phi Sigma Pi – CHAPTER, its officers, directors, agents, or representatives. Furthermore, I fully and completely agree to defend and indemnify Phi Sigma Pi – CHAPTER, its officers, directors, agents, and representatives in the event that any claim or suit is brought against Phi Sigma Pi – CHAPTER, its officers, agents, directors, or representatives, arising out of any act or omission caused or committed by me, in whole or in part, including payment of all legal fees and costs incurred in defense of any such claim. I also agree to indemnify and reimburse Phi Sigma Pi – CHAPTER, its officers, agents, directors, and representatives for all legal costs and expenses incurred in pursuit of the enforcement of this agreement.
Furthermore, I hereby covenant, warrant and agree not to bring any lawsuit or other claim against Phi Sigma Pi – CHAPTER, its officers, agents, directors, or representatives in the event that I sustain any personal injury or illness during that time, whether or not caused by the sole or concurrent fault, act, and/or omission of the said Phi Sigma Pi – CHAPTER, its officers, directors, agents, or representatives. I hereby acknowledge and agree that in consideration for the right to attend this service event, I fully agree to waive and forego any and all rights as described above. I also acknowledge that I have read this agreement in its entirety and fully understand its contents.
